These Terms and Conditions (“Terms”) govern your use of the website soulswara.com and all courses, programmes, and services offered by:

“Soul Swara”, “we”, “us”, and “our” refer to Soul Swara Private Limited. “You” and “your” refer to the person accessing the website or enrolling in a programme.

By accessing this website, creating an account, or enrolling in any course or programme, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Refund, Cancellation & Subscription Policy. If you do not agree, please do not use our website or services.

If you are enrolling on behalf of a minor (a person under 18 years of age), you confirm that you are that person’s parent or legal guardian, that you have read and accepted these Terms on their behalf, and that you accept responsibility for their use of our services.

Soul Swara offers structured Carnatic music education through its Online Certificate Program (OCP), delivered across six trails: Foundation Trail, Preparatory Trail 1, Preparatory Trail 2, Skill Trail, Expression Trail, and Artistry Trail. Students progress through three service tiers depending on their enrolment level:

Tier 1 — Self-Paced Learning

Fully self-paced access to structured video curriculum, play-along tracks, ear training modules, and weekly practice quests. Students learn independently at their own pace with no scheduled live sessions.

Tier 2 — Self-Paced with Milestone Live Access

All Tier 1 content, plus access to live sessions with a teacher upon reaching defined programme milestones. These sessions are for questions, doubt clarification, and guidance — not structured teaching classes. Live access is unlocked progressively as the student advances through the curriculum.

Tier 3 — Full Live Programme

Full live programme with weekly sessions with a qualified teacher. Tier 3 subscription, cancellation, and refund terms are communicated directly to students at the time of enrolment. Please refer to your enrolment documentation for the full terms applicable to your Tier 3 plan.

All tiers include:

• Access to structured video curriculum and play-along tracks
• Ear training modules and weekly practice quests
• Swara Circle community access
• Milestone certificates upon trail completion

The specific tier applicable to your enrolment will be confirmed in your enrolment communication. We reserve the right to modify, add, or discontinue any feature or service with reasonable notice to enrolled students. Where a modification materially reduces access or content that a student has already paid for, Soul Swara will offer an appropriate remedy in accordance with our Refund, Cancellation & Subscription Policy and applicable law.

Our programmes are designed for personal skill development and musical education. Enrolment in and completion of Soul Swara programmes does not:

• constitute a professional music qualification or degree recognised by any university or statutory body;
• guarantee any specific outcome, level of skill attainment, or career result.

Results depend significantly on individual effort, practice, regularity, and personal aptitude. We are committed to providing excellent instruction, but we cannot guarantee identical results for every student.

You must be at least 18 years old to enrol independently. Students under 18 may enrol only with the consent and active participation of a parent or legal guardian, who must complete enrolment on the student’s behalf.

You are responsible for:

• providing accurate enrolment information;
• keeping your account credentials confidential;
• notifying us promptly at [email protected] of any unauthorised access to your account.

Fees are as published on our website or communicated to you at the time of enrolment. Indian residents are charged in INR and GST at 18% is applicable. International students are charged in USD and no GST applies (Soul Swara holds a Letter of Undertaking — LUT — for export of services).

Payment is collected via Razorpay (or an equivalent payment gateway). Monthly plans are set up as recurring auto-debit mandates. Six-month and annual plans are collected as a one-time upfront payment. Where Razorpay is unavailable in your region, payment may be made by bank transfer; Soul Swara will confirm the arrangement in writing.

Full details of payment schedules, auto-debit, and grace periods are set out in our Refund, Cancellation & Subscription Policy, which forms part of these Terms.

Our full refund and cancellation terms are set out in the Soul Swara Refund, Cancellation & Subscription Policy, which is published on our website and incorporated into these Terms by reference. In summary:

• Fees are non-refundable by default.
• Change of mind and dissatisfaction with teaching format or content do not qualify for a refund.
• Tier 3 (Full Live Programme) refund and cancellation terms are communicated directly to students at the time of enrolment — please refer to your enrolment documentation.

In the event of any conflict between these Terms and the Refund, Cancellation & Subscription Policy on a matter of refunds, subscriptions, or cancellations, the Refund, Cancellation & Subscription Policy shall prevail.

Course content delivered as part of our programmes — including video lessons, curriculum materials, play-along tracks, audio recordings, and ear training modules — is the intellectual property of Karthick Srinivasan and is licensed to Soul Swara Private Limited for the purpose of programme delivery. Website content, platform materials, the Soul Swara brand, course structure, and written programme materials are owned by or licensed to Soul Swara Private Limited. All such content is protected under the Copyright Act, 1957 (India) and applicable international copyright law.

You are granted a personal, non-exclusive, non-transferable licence to access and use course content solely for your own personal, non-commercial educational purposes during your active subscription.

You may not, except where permitted by applicable law:

• record, copy, screenshot, screen-record, or reproduce any live class without our prior written permission;
• share, distribute, resell, sub-licence, or publish any course content, lesson videos, curriculum materials, or class recordings;
• create derivative works based on our content.

Violations may result in immediate cancellation of your subscription (without refund) and may give rise to legal action under the Copyright Act, 1957 and applicable international copyright laws and treaties.

Access to content does not transfer ownership of any intellectual property rights to you.

Soul Swara™ and the Soul Swara name and logo are trade marks of Soul Swara Private Limited (trade mark applications pending). Unauthorised use is prohibited.

This clause applies to Tier 2 students who have access to milestone live sessions, and to Tier 3 students as governed by their enrolment documentation.

Our live sessions take place on Google Meet. By joining a session, you agree to:

• conduct yourself with courtesy and respect toward teachers, staff, and fellow students;
• not record the session in any form without prior written permission from Soul Swara;
• not share your meeting link with any person not enrolled in that batch.

Soul Swara reserves the right to remove a student from a live session and, in serious cases, cancel their subscription (per clause 10 below) if these obligations are not met.

Soul Swara reserves the right to suspend or cancel a subscription with immediate effect and without refund of the remaining paid period in cases of:

• abusive, threatening, or disrespectful conduct toward teachers, staff, or other students;
• repeated disruption of live classes after a written warning (Tier 2 and Tier 3 students);
• unauthorised recording, sharing, or distribution of class content, course materials, or teacher sessions.

Where possible, we will issue a written warning before taking this step. In serious cases, suspension may take effect immediately. Any such decision will be communicated in writing.

Our services involve third-party platforms including Google (Google Meet, Google Workspace) and Razorpay. Your use of those platforms is subject to their respective terms of service. We are not responsible for downtime, outages, or changes to third-party services. Where a class cannot be delivered due to a third-party platform issue, we will make reasonable efforts to reschedule.

To the fullest extent permitted by applicable law, Soul Swara Private Limited and its directors, employees, and instructors shall not be liable for:

• any indirect, incidental, or consequential loss arising from your use of our services;
• loss of data, loss of income, or loss of opportunity;
• interruptions to service caused by events outside our reasonable control.

Our total liability to you in connection with any claim under these Terms shall not exceed the portion of fees you have paid for the current enrolment period that corresponds to access not yet received at the time the claim arises (i.e., the unused future portion of your paid term only; fees for access already consumed are excluded). Nothing in these Terms limits liability for death, personal injury, fraud, or any matter that cannot be excluded under applicable law including the Consumer Protection Act, 2019.

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall first be referred to us in writing at [email protected]. We will make every reasonable effort to resolve the matter amicably within 14 days. If the matter cannot be resolved amicably, it shall be subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu, India, subject to any non-excludable rights you may have under applicable consumer law to bring a complaint before a relevant consumer forum.

In accordance with the Consumer Protection (E-Commerce) Rules, 2020 and the Digital Personal Data Protection Act, 2023, we have appointed a Grievance Officer:

The Grievance Officer will acknowledge complaints within 24 hours of receipt and endeavour to resolve them within one month.

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

These Terms, together with the Privacy Policy and the Refund, Cancellation & Subscription Policy, constitute the entire agreement between you and Soul Swara Private Limited with respect to the subject matter hereof and supersede all prior or contemporaneous representations, understandings, or agreements, whether written or oral. In the event of any conflict between these Terms and the Refund, Cancellation & Subscription Policy on a matter of refunds or cancellations, the Refund, Cancellation & Subscription Policy shall prevail.

We may update these Terms from time to time. Material changes will be communicated to enrolled students at least 15 days before they take effect via email or WhatsApp. Your continued use of our services after the effective date of any revision constitutes your acceptance of the updated Terms.
